Abstract： The boundaries of modern basic research have been constantly broadened. Basic research started from the era of “small science” dominated by the free exploration of academic institutions and stepped into the era of “big science” dominated by the state, with all sectors of society working together to promote collaborative innovation. The current management system of basic research in China has gone through several stages of adjustment, and a relatively complete funding system for basic research has been formed. Nevertheless, the resource allocation, organizational model and legal guarantee of basic research still need to be improved continuously.

Abstract： Under the new situation, it is an important task and strategic measure to promote the global governance of intellectual property in China. In recent years, the trend of global intellectual property governance structure has undergone profound changes, especially the tremendous adjustment and innovation of international intellectual property rules and systems. On the other hand, the United States takes intellectual property issues as an excuse to create Sino-US trade frictions and undermine the international economic and trade order and governance system. All these things pose a severe challenge to the global governance environment of intellectual property rights in China. At present, China is at a disadvantage situation in the game of global intellectual property rights rules, the role of intellectual property rights in emerging fields to support global competition is limited, and the international environment of intellectual property rights faced by enterprises is becoming increasingly severe. What’s more, the government’s overseas intellectual property service capacity still needs to be improved. In order to raise the level of global intellectual property governance in China, it is necessary to lead the establishment of regional intellectual property cooperation organizations, strengthen intellectual property protection and cooperation in emerging fields, actively integrate into the global intellectual property governance system, and enhance the public service capacity of government overseas intellectual property rights.

Abstract： The study of the legal governance system of American basic research focuses on two dimensions, (1) The composition of American basic research system and the related legal basis. The American basic research system is a highly complex and dynamic system, including the US Science Foundation, which is dedicated to the free exploration of basic research, and the “mission-oriented basic research” agencies such as the National Institutes of Health, the US Energy Agency, and the National Aeronautics and Space Administration, which focuses on national security and social development needs. (2) The legal and regulatory framework for the implementation of different types of basic research differs. There are different legal rules governing the source of funding, the form of funding agreements, the composition of funding, and the administration of free exploratory basic research and task-oriented basic research projects.
